Permits and by-laws in Halton Hills: what you need

Building permits for decks, sheds, pools and renovations, 2026 permit fees, fence rules, fireworks and reporting by-law concerns.

In Halton Hills you need a building permit before you build, add to, renovate or demolish, including decks, sheds over 15 square metres, new plumbing and structural changes; pools need their own enclosure permit. Applications are accepted electronically only, and fees are paid when you apply. Building permits

When do I need a building permit in Halton Hills?

The Town says a permit is needed to build, demolish or change the use of a building, and it is illegal to start without one. Its list includes new houses and additions, decks, sunrooms, detached garages and carports, gazebos, sheds larger than 15 square metres, accessory apartments, new plumbing, solar panels, wood stoves and fireplaces, finishing a roughed-in bathroom, removing or adding a structural wall, and septic systems.

The same page says structures of 10 square metres or less generally need no permit, though some (with plumbing, for example) still do; for anything between 10 and 15 square metres, check with Building Services.

What work does not need a permit?

The Town lists work that does not need a building permit: air conditioners for houses, kitchen or bathroom cupboards with no plumbing work, retaining walls under 1 metre high, a furnace replaced with one of the same output and fuel, new shingles on a house, and painting, decorating or general maintenance.

How do I apply for a building permit?

The Town accepts building permit applications electronically only. Fill in the Province's Application to Construct or Demolish, attach the drawings and documents for your project, and submit it through the Town's online form; fees are paid when you submit. Drawings must meet the 2024 Ontario Building Code, in effect since 1 January 2025, and you may also need an Applicable Law Declaration and approvals from other agencies such as a conservation authority.

Changes to approved drawings after a permit is issued need a separate revision permit.

How much does a residential building permit cost in 2026?

The Town's 2026 Rates and Fees by-law sets building permit fees for the year, which took effect on 1 January 2026. Some common residential fees are below; area-based fees are charged per square metre of floor area.

Pools, fences and grading

Do I need a permit for a pool or hot tub?

Yes. A Pool Enclosure Permit is needed before you install or alter an outdoor pool, in-ground or above-ground, a hot tub or spa that is not fully enclosed by a building, or any fence or barrier that is part of a pool enclosure. Apply with a site plan showing the pool, enclosure and gates and details of the fencing and locks. Requirements under the Town's Pool Enclosure By-law can include a minimum fence height, self-closing and self-latching gates, and limits on openings and climbable features.

The pool must not be filled or used until the enclosure has passed inspection.

How high can my fence be?

In a residential zone, a fence can be up to 2.13 metres (7 feet) high in a rear yard or side yard, and no higher than 0.9 metres (3 feet) in a front yard. On a corner lot, fencing in the sight triangle near the intersection is limited further, and no fence may block a driver's view or the view of approaching pedestrians or traffic. Fences may not be built of plywood or scrap metal.

If a fence cannot meet the Fence By-law, you can apply for a variance; the 2026 amendment has Council decide it after nearby owners are notified.

Who pays for a fence between neighbours?

Since April 2026 the Town's Fence By-law, not the provincial Line Fences Act, governs fences on a shared property line. If neighbours agree, each does or pays for their agreed share. If they cannot agree, an owner can still build, replace or repair the fence after serving a written notice of intent with at least three quotes, by registered mail or in person; work can start 14 business days later. The neighbour pays 50 per cent of the basic cost, defined as the cost of a 1.2-metre (4-foot) vinyl-coated wire mesh fence built to the by-law's specification, and the owner pays the rest.

The neighbour can send up to three quotes of their own within 10 business days. Damage to a shared fence is paid by whoever caused it, split evenly after a natural disaster, and paid by the tree's owner when a tree causes it.

Do I need a permit to regrade my yard or bring in fill?

You need a Site Alteration Permit under By-law 2025-0009 if your project involves placing or dumping fill, removing topsoil, changing the slope or grade of land, or hauling soil within the Town. The permit protects roads, ditches, drainage and natural features such as wetlands and the Niagara Escarpment. Talk to the Town's Development Engineering staff about your project before applying.

Work that affects Town-owned land, such as a road allowance or drainage system, may need further approvals.

By-laws and enforcement

How do I report a by-law violation in Halton Hills?

Complete an Enforcement Service Request. The Town's municipal law enforcement officers enforce all of its by-laws, and its Resident Guide groups the common ones, including property standards, community standards (long grass, dumping, graffiti), fences, pool enclosures, idling, signs, parks, pets and noise, with the by-law for each.

Enforcement Services does not take anonymous complaints. For immediate, emergency help outside business hours, the Town directs residents to Halton Regional Police Service.

Can I set off fireworks in Halton Hills?

Not consumer ones. Under Fireworks By-law 2025-0006, using, selling, buying, possessing or setting off family fireworks such as roman candles, fountains and ground spinners is banned in Halton Hills; sparklers are allowed. Display fireworks are permitted only when set off by a federally approved fireworks technician under a Town permit. A first offence costs an individual $800, rising to $1,200 and then $1,500 for later offences.

When fireworks are set off from private property, the owner is deemed to have allowed it and can be charged. Report illegal fireworks to Enforcement Services at 905-873-2600, ext. 2330.
